Mobile Messaging Program Terms of Service

ESA Management, LLC and ESH Hospitality Strategies, LLC and its subsidiaries (collectively, “ESH,” “we,” “us,” or “our”) maintain and offer this Mobile Messaging Program (“the Program”) to users in the United States who wish to receive SMS text messages regarding deals and discounts you may be eligible to receive. The Program is governed by our Privacy Policy and these Terms of Service. You may enroll in the Program at https://www.extendedstayamerica.com/extended-perks/index. Your enrollment in the Program constitutes your acceptance of these Terms of Service and our Privacy Policy. (https://www.extendedstayamerica.com/privacy-policy).

The Program
If you enroll in the Program, we may send you promotional mobile messages via SMS. Promotional texts notify you of deals or promotions we think may be of interest to you. We send these messages using automated technology, including an automated system that sends the messages on our behalf. Message frequency may vary, but we will never send more than one promotional message per day. We do not charge a fee for this service. However, depending on your mobile phone plan, you may incur fees for your receipt of messages. Message and data rates may apply.

Joining the Program
By providing your mobile phone number to us on the Program signup page (https://www.extendedstayamerica.com/extended-perks/index), you are voluntarily opting into the Program. Your opt-in constitutes your permission for us to send Program messages even if your number is on any state, federal, or other “Do Not Call” list. You agree that the number you enter is a valid mobile number and that you are the owner or an authorized user. Your participation in the Program is completely voluntary and optional and is not required in order to make any reservation or stay with us. After signing up, you will receive a text message from 61932 on your mobile number.

Opt-Out
Once you have joined the Program, you may opt-out at any time by replying “STOP” to any message we send. Once we have processed your opt-out, you will receive a final message confirming your opt-out and no additional messages. If you leave the Program and decide you would like to join again, you can simply sign up again by texting “JOIN” to 61932.

Compatible carriers include AT&T, T-Mobile®, Verizon Wireless, Sprint, Boost, Alltel (Verizon Wireless), U.S. Cellular, Cellular One, MetroPCS, ACS/Alaska, Bluegrass Cellular, Cellular One of East Central Illinois, Centennial Wireless, Cox Communications, EKN/Appalachian Wireless, GCI, Illinois Valley Cellular, Immix/Keystone Wireless, Inland Cellular, Nex-Tech Wireless, Rural CellularCorporation, Thumb Cellular, United Wireless, West Central (WCC), Cellcom, C Spire Wireless CellSouth, Cricket, Cincinnati Bell, and Virgin Mobile®.

Carriers are not liable for delayed or undelivered messages.

Disclaimer
We offer the Program on an “as-is” basis to U.S.-based phone numbers only. Depending on where you live and the mobile carrier you use, the Program may not be available to you. You agree that we will not be liable for any failure to deliver promotional messages to you in a timely manner.

Program Modifications
You understand and agree that we may modify or cancel the Program at any time without notice, including modifications to these Terms of Service. Changes to these Terms of Service or our Privacy Policy (https://www.extendedstayamerica.com/privacy-policy) will be posted online, along with the date of the last update. You are invited to periodically review these Terms of Service and our Privacy Policy for any updates. Should you object to any changes, you are invited to opt-out at any time. Otherwise, your continued participation in the Program constitutes your acceptance of the then current Terms of Service or Privacy Notice as posted online.
