Learn MoreThese standard terms and conditions (“Rules”) apply to ESH Strategies Branding LLC’s monthly giveaways (each, a “Promotion”) that adopt or otherwise reference these Rules (for example, by providing a link to these Rules).
PROMOTION PERIOD: The specific monthly timeline of the Promotion (the “Promotion Period”) is provided in the communications about the Promotion, but the Promotion Period will begin at 12:00:01 a.m. ET on the first calendar day of the specified month and end at 11:59:59 p.m. ET on the last calendar day of the specified month. In the event any type of promotion is recurring from month-to-month, each Promotion shall stand alone, and entries from one Promotion will not carry over to any other Promotion. Also, there is no guarantee that any particular Promotion will be recurring or will continue to recur in the future; rather, Sponsor (as defined below) reserves the right to cancel any recurring promotions at any time and for any reason.
ELIGIBILITY: The Promotion is open to legal residents of the 50 United States and the District of Columbia who are at least 18 years of age and the age of majority in their jurisdiction of residence at the time of entry. Void where prohibited. Employees of ESA Management, LLC (“Sponsor”) and its parent companies, franchisees, subsidiaries, affiliates, and vendors providing services in connection with this Promotion (collectively, the “Sponsor Affiliates”), and employees, agents, directors, officers (including members of their immediate family – i.e., spouse, mother, father, in-laws, grandmother, grandfather, brother, sister, children and grandchildren – or those living in the same household) of Sponsor or any Sponsor Affiliates are not eligible to enter this Promotion. Promotion is subject to all applicable federal, state, and local laws.
PERKS PROGRAM ENROLLMENT REQUIRED: To participate and be eligible for the Promotion, each entrant must be a member in good standing (as determined by Sponsor in its sole discretion) of the Extended Perks Reward Program. Enrollment in the program is free, and you may join at https://www.extendedstayamerica.com/extended-perks/. You must agree to the additional terms and conditions required for enrollment in the program.
TO PARTICIPATE: The maximum number of total entries per month is the number of days in each respective month (i.e., January maximum number of entries is 31; April maximum number of entries is 30), regardless of the methods of entry (the “Maximum Entry Level”). During the Promotion Period, there are two ways to enter:
1. Consumed Stay. During the Promotion Period, complete a paid stay at an Extended Stay America hotel location. Free room nights and other unpaid promotional stays may not be eligible for entry in this Promotion. For each night consumed, the eligible entrant will be automatically enrolled for one (1) entry per night during the Promotion Period.
2. Mail-In Entry. During the Promotion Period, handwrite the following information on an 8.5” x 11” piece of white paper: (i) your first and last name, (ii) the email address associated with Extended Perks Reward Program account, (iii) your home address, (iv) your telephone number; and (v) your contact email address (if different than ii). The information you provide must be complete, truthful, accurate, and legible (as determined by Sponsor in its sole discretion). The completed entry must be mailed to the following address: ESA Management, LLC; Attn: Marketing Department; 13024 Ballantyne Corporate Place, Suite 1000, Charlotte, NC 28277. Entries must be postmarked during the Promotion Period and received within five (5) days of the close of the Promotion Period. Any late or misdirected entries will not be considered, and a failure to provide all of the information required shall render the submitted entry as void. Sponsor is not responsible for lost, late, or misdirected entries, or entries not received regardless of cause.
WINNER DRAWING: Following the close of the Promotion Period, Sponsor will randomly select the potential winner(s) from among all eligible entries received by the Sponsor, whose decisions are final and binding. The number of winners will not exceed the number advertised in connection with the Promotion. Odds of winning a Prize (defined below) will depend on the total number of eligible entries received. Up to ten (10) winners per month for the Promotion.
PRIZE: Subject to the limitations stated below, the verified winner(s) will be awarded: Prize valued up to $500* per winner (the “Prize”). Prizes are provided "AS IS" and are subject to the terms, conditions, and limitations of the issuer. Neither Sponsor nor Sponsor Affiliates make or offer any warranty or guarantee, either express or implied (including, without limitation, quality, merchantability and fitness for a particular purpose) in connection with this Promotion or any Prize. Any other costs and expenses associated with Prize acceptance and use not specifically provided herein are the sole responsibility of the participant. Prize is subject to the limitations, terms, and conditions of the manufacturer and provider. Prize details and availability are subject to change, in which case a Prize of equal value may be substituted at Sponsor’s sole discretion. Prizes consist only of the items listed, are non-transferable, with no cash redemption or substitution except at Sponsor's sole discretion. Federal, state, or local taxes on Prizes, if any, and any other costs, fees or expenses not listed above are the sole responsibility of the participant. *Prize value may vary depending on location. No difference in the actual value will be awarded.
NOTIFICATION:
Each potential winner will be contacted, at the Sponsor’s sole and complete discretion, via phone/ by mail/by email address and provided with information and directions to timely claim the Prize. Acceptance and/or use of the Prize shall further indicate the winner’s acceptance of these Rules. Sponsor shall have no liability for any winner notification that is lost, intercepted or not received by a potential winner for any reason. If a potential winner does not fully respond as instructed within twenty-four (24) hours after the first notification attempt, or if the Prize or notification is returned as unclaimed or undeliverable to such potential winner, such potential winner may be disqualified and an alternate winner may be selected. If any potential winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines a Prize for any reason prior to award, such potential winner will be disqualified and an alternate winner may be selected. Each potential winner may be required to execute an Affidavit of Eligibility, a Liability Release, and (where permitted by law) a Publicity Release. Note: The documents sent to a potential winner may require that the winner provide his or her Social Security Number to the Sponsor, which will be used solely for tax reporting purposes. At Sponsor’s discretion, Recipient may be required to produce picture or some other form of proper identification to receive any Prize.
PUBLICITY & MARKETING: Acceptance of any Prize constitutes permission to the Sponsor to use the participant’s name and likeness for purposes of advertising and trade, in any medium, without further compensation or notice, unless prohibited by law. Submission of contact information in connection with the Promotion (whether or not required), including mailing address, phone number, and email address constitutes permission for Sponsor to add entrant to Sponsor’s customer database and to contact entrant in the future for promotional and other reasons. You may opt-out of receiving such communications provided within any such marketing materials (e.g., using the “Unsubscribe” feature provided in the footer of Sponsor’s emails).
NO LIABILITY & INDEMNIFICATION: Sponsor and Sponsor Affiliates are not responsible for and entrants release each from any failures of any kind (whether caused by computer, technical, or human error) which may either limit the entrant’s ability to submit an entry, receive a Prize, or otherwise participate in this Promotion, or Sponsor’s ability to include all eligible participants, notify the potential participants and Recipients, or otherwise execute this Promotion in the manner intended. Participants further release and agree to indemnify Sponsor and Sponsor Affiliates from any and all liability, claims or actions of any kind whatsoever arising from injuries, damages, or losses to persons or property which may be sustained in connection with this Promotion including, but not limited to: (a) the receipt, ownership or use of any Prize; (b) any travel or Prize-related activity; (c) any typographical or other error in these Rules or any other materials disseminated by Sponsor; (d) any claim of damage or harm made against Sponsor or Sponsor Affiliates by Recipient; (e) any use of or participation in the Program, and (f) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with any equipment, systems, networks, lines, satellites, servers, computers, or providers used by an entrant or Sponsor.
DISPUTES: By entering the Promotion, each participant agrees, to the extent allowed by applicable law, that (i) any and all disputes, claims, and causes of action arising out of or in connection with the Promotion, or any prize awarded, shall be resolved individually without resort to any form of class action; (ii) any claims, judgments and awards shall be limited to reasonable and actual out-of-pocket costs incurred, including costs associated with entering the Promotion, but in no event attorney's fees; and (iii) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental, indirect or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for reasonable and actual out-of-pocket expenses. To the fullest extent permitted by law, entrant agrees that any and all disputes, claims and causes of action arising out of or connected with this Promotion or the awarding of prizes shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Western District of North Carolina or an appropriate North Carolina State Court. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of the entrant and Sponsor in connection with the Promotion shall be governed by and construed in accordance with the laws of the State of North Carolina, without giving effect to any choice of law or conflict of law rules (whether of the State of North Carolina or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of North Carolina.
OTHER TERMS: Decisions of Sponsor on all matters related to the Promotion are final. Sponsor reserves the right to cancel or modify the Promotion for any reason, including but not limited to, if fraud, misconduct or technical failures destroy the integrity of the Promotion, or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper administration of the Promotion as determined by Sponsor, in its sole discretion. Sponsor reserves the right to disqualify or prohibit the participation of an individual or business if fraud or tampering is suspected, or if the individual or business fails to comply with any requirement of participation or with any provision in these Rules. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL & CIVIL LAWS. SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND/OR SEEK DAMAGES TO THE FULL EXTENT PERMITTED BY LAW.
